• Not attempt to circumvent any security features or access restrictions
• Not use automated systems or software to extract data from our services
• Ensure you have the right to upload and process any images you submit
• Comply with all applicable local, state, national, and international laws

5.1 Your Content

You retain all ownership rights to the images and content you upload to our services. By uploading content, you grant us a limited, non-exclusive, worldwide license to process, store, and display your content solely for the purpose of providing our services to you.

5.2 Our Content

All content, features, and functionality of our services, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof, are the exclusive property of AI Photo Enhancer and are protected by copyright, trademark, and other intellectual property laws.

5.3 Processed Images

Images processed through our services remain your property. We do not claim ownership of the output generated from your uploaded images. However, we reserve the right to use anonymized, aggregated data for service improvement purposes.

You agree not to use our services to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• Upload content containing viruses, malware, or any other harmful code
• Interfere with or disrupt the services or servers or networks connected to the services
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Create fraudulent identification documents or assist in identity fraud
• Process images of minors without proper parental consent
• Use the services for any commercial purpose without our prior written consent
• Attempt to reverse engineer, decompile, or extract the source code of our software

We reserve the right to investigate and take appropriate legal action against anyone who violates this Acceptable Use Policy, including removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities.

7.1 Credit System

Our services operate on a credit-based system. Credits are required to process images and use various features. Credit packages can be purchased through our website.

7.2 Non-Refundable Policy

All credit purchases are final and non-refundable, except in the following special circumstances:

• Unauthorized transactions due to stolen credit card or payment method
• Purchases made by minors without parental consent
• Technical errors resulting in duplicate charges
• Service unavailability preventing credit usage within a reasonable timeframe

All refund requests must be submitted via email to our support team and will be manually reviewed on a case-by-case basis. We reserve the right to request additional documentation to verify refund claims.

7.3 Credit Expiration

Credits do not expire unless otherwise stated at the time of purchase. However, we reserve the right to implement expiration policies with reasonable notice to users.

7.4 Pricing Changes

We reserve the right to modify our pricing and credit packages at any time. Changes will not affect credits already purchased.

IMPORTANT: While our Passport Photo service is designed to help create passport photos that meet common government requirements, AI Photo Enhancer does not guarantee that photos generated through our services will be accepted by any government agency, passport office, or official authority.

Government photo requirements vary by country and can change without notice. It is your responsibility to:

• Verify current photo requirements with the relevant government authority
• Ensure your photo meets all specific requirements before submission
• Review the final photo for compliance before using it for official purposes

Credit Refund for Rejected Photos:

If your passport photo is rejected by a government authority due to technical non-compliance (not due to the photo subject itself), you may request a credit refund by emailing our support team with:

• The original photo generated by our service
• Official rejection notice from the government authority
• Specific reason(s) for rejection

All such requests will be manually reviewed, and credits may be refunded at our sole discretion if we determine the rejection was due to a service error or technical deficiency in our processing.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, Passport Photo disclaims all warranties, express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding the accuracy, reliability, or completeness of the services
• Warranties that the services will be uninterrupted, timely, secure, or error-free
• Warranties regarding the quality of any products, services, information, or other material obtained through the services
• Warranties that defects will be corrected or that the services are free of viruses or other harmful components

We do not warrant that the results obtained from using our services will meet your requirements or that the services will be compatible with all devices or operating systems.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PASSPORT PHOTO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or use
• Loss of business opportunities
• Damage to reputation or goodwill
• Cost of procurement of substitute goods or services
• Any damages arising from rejection of photos by government authorities
• Any damages resulting from unauthorized access to or alteration of your transmissions or data
• Any damages resulting from errors, mistakes, or inaccuracies in content
• Personal injury or property damage resulting from your use of the services

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability to you for all damages exceed the amount paid by you to Passport Photo in the twelve (12) months preceding the claim.

We take data privacy and security seriously. Your use of our services is also governed by our Privacy Policy. We implement reasonable security measures to protect your data, but we cannot guarantee absolute security.

You acknowledge that:

• Internet transmissions are never completely private or secure
• Any message or information you send may be read or intercepted by others
• You are responsible for maintaining the confidentiality of your account

We reserve the right to suspend or terminate your access to the services at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Technical or security reasons

Upon termination, your right to use the services will immediately cease. Unused credits will be forfeited unless termination was due to our breach of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AI Photo Enhancer operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the services shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in a class action lawsuit or class-wide arbitration.
